The purpose of this Personal Data Protection Guidelines (hereinafter referred to as the Confidentiality Policy) is to lay down the principles applying in respect of all information about the User that can be obtained by the Online Store «Zlitay» located on the domain name zlitay.com while the User is using the Online Store website, as well as programs and products of the Online Store.
- DEFINITION OF TERMS
1.1 The following terms are used in this Confidentiality Policy:
1.1.1. “Online Store Website Administration (hereinafter referred to as the Website Administration)” means the employees authorized for the site management and acting on behalf of «Zlitay», which arrange and/or carry out processing of personal data and also determine the goals of processing of personal data, scope of personal data subject to processing and actions (operations) performed with the personal data.
1.1.2. “Personal data” mean any information related directly or indirectly to identified or identifiable natural person (personal data owner).
1.1.3. “Processing of personal data” is any action (operation) or package of measures (operations) performed with or without automated facilities for personal data processing, including data collection, recording, systematization, accumulation, storage, refinement (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion and destruction of personal data.
1.1.4. “Personal data confidentiality” is a requirement binding upon the Operator or any other person having access to the personal data prescribing not to distribute any personal data without the consent of the personal data owner or where legally permitted.
1.1.5. “Website User” (hereafter referred to as the User) is a person having access to the website via the Internet and using the Online Store website.
1.1.6. “Cookies” mean a small piece of data transferred by a web server and stored in the User’s computer forwarded by the web client or web browser to the web server in HTTP query while the user is attempting to open up a page of the respective website.
1.1.7. “IP address” is a unique network address of a node in computer network arranged on the basis of IP protocol.
- GENERAL PROVISIONS
2.1. Any use of the Online Store website by the User means agreement with the provisions of this Confidentiality Policy and conditions of the User’s personal data processing.
2.2. In the event that a User disagrees with the provisions of the Confidentiality Policy, the User must stop using the Online Store website.
2.3. This Confidentiality Policy applies in respect of the website of the Online Store «Zlitay». The Online Store neither controls, nor bears liability for the privacy practices of any third-party websites, which can be accessed by the User via the links available on the Online Store website.
2.4. The Website Administration does not check the validity of the personal data provided by the User of the Online Store website.
- SUBJECT OF CONFIDENTIALITY POLICY
3.1. This Confidentiality Policy establishes the obligations of the Online Store Website Administration to nondisclosure and privacy protection of the personal data provided by the User on request of the Website Administration upon registration on the Online Store website or at the time of placement of the purchase order.
3.2. The personal data allowed for processing hereunder shall be provided by the User by means of completion of the Registration Form available on the website of the Online Store «Zlitay» in section “Checkout” and shall include the following information:
3.2.1. User’s full name;
3.2.2. User’s contact telephone number;
3.2.3. User’s e-mail address (e-mail);
3.2.4. Delivery address;
3.2.5. User’s place of residence.
3.3. The Online Store protects data automatically transmitted while the User is browsing the advertising blocks and accessing the website pages, on which the statistical script of the system (“pixel”) is installed:
- IP address;
- information from Cookies;
- Information on the browser (or other adware program);
- access time;
- address of the page where the advertising block is located;
- referrer (address of the previous page).
3.3.1. Disabling of cookies may result in inability to access the sections of the Online Store website requiring authorization.
3.3.2. The Online Store shall collect statistics in respect of the Users’ IP addresses. This information shall be used for the purpose of identification and management of technical issues and financial payment legality checking.
3.4. Any other personal information non-stipulated above (purchase history, used browsers and operational systems etc.) shall be subject to safe storage and non-disclosure, except in cases established by clauses 5.2. and 5.3. hereof.
- PURPOSES OF THE USER’S PERSONAL INFORMATION ACQUISITION
4.1. The Online Store Website Administration shall be entitled to use the User’s personal data for the following purposes:
4.1.1. Identification of User registered on the Online Store website for placement of the purchase order and (or) conclusion of a contract for sale and purchase of goods with «Zlitay» by remote means.
4.1.2. Granting access to the personalized resources of the Online Store website.
4.1.3. Coupling back with the User including filing of notifications and requests concerning the use of the Online Store website, provision of services, processing of the User’s inquiries and applications.
4.1.4. Determination of the User’s location for reasons of safety and fraud prevention.
4.1.5. Attestation of the accuracy and completeness of personal data provided by the User.
4.1.6. Creating a user account to make purchases, if the User has agreed to create an account.
4.1.7. Notification of the User of the Online Store website about the status of the Order.
4.1.8. Processing and receipt of payments, proof of tax payment or tax benefits, contestation of payment, determination of the right to receive a credit line by the User.
4.1.9. Provision of effective technical assistance and customer support in the event of problems associated with the use of the Online Store website.
4.1.10. Provision of product updates, special offers, pricing information, newsletters and other information on behalf of the Online Store or on behalf of the partners of the Online Store with the consent of the User.
4.1.11. Implementation of promotional activities with the consent of the User.
4.1.12. Granting access to the websites or services of the partners of the Online Store in order to obtain products, updates and services.
- METHODS AND TIMEFRAME FOR PERSONAL DATA PROCESSING
5.1. The User’s personal data shall be processed for an unlimited period of time in any way and by any legal means, including personal data information systems with or without automated facilities.
5.2. The User agrees that the Website Administration may transfer personal data to third parties, including courier services, postal services, telecommunication providers solely for the purposes of execution of the User’s order placed on the website of the Online Store «Zlitay» including product delivery.
5.3. The User’s personal data may be transferred to the competent public authorities of Ukraine on the grounds and in accordance with the procedure established by the legislation of Ukraine.
5.4. In case of loss or disclosure of personal data, the Website Administration shall inform the User about the loss or disclosure of the personal data.
5.5. The Website Administration shall take the necessary organizational and technical measures to protect the User’s personal information against unauthorized or inadvertent access, destruction, alteration, blocking, copying and dissemination, as well as against other inappropriate actions of third parties.
5.6. The Website Administration together with the User shall take the necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the personal data of the User.
- OBLIGATIONS OF THE PARTIES
6.1. The User shall assume the following obligations:
6.1.1. The User shall provide the personal details required to use the Online Store website.
6.1.2. The User shall update and supplement the personal details in case of any change of such information.
6.2. The Website Administration shall assume the following obligations:
6.2.1. The Website Administration shall use the acquired information exclusively for the purposes indicated in paragraph 4 hereof.
6.2.2. The Website Administration shall provide storage of confidential information under seal of secrecy and shall not disclose information without the prior permission in writing of the User. Besides, the Website Administration shall not sell, exchange, publish or disclose in any other possible way the transferred personal data of the User, except in cases established by clauses 5.2. and 5.3. hereof.
6.2.3. The Website Administration shall take precautions for the User’s personal data privacy protection in accordance with the procedure commonly used to protect this type of information in customary business practices.
6.2.4. The Website Administration shall perform blocking of personal data related to the respective User from the moment of making a request or application by the User or its legal representative or authorized body for protection of personal data owner rights for the check-out period, in the event of the discovery of any inadequate information or inappropriate actions.
- LIABILITY OF THE PARTIES
7.1. The Website Administration shall be liable for any and all damages caused to the User due to unauthorized usage of the personal data in accordance with the legislation of Ukraine, except in cases established by clauses 5.2, 5.3 and 7.2. hereof.
7.2. In case of a loss or disclosure of the personal data, the Website Administration shall not be liable, if such confidential information:
7.2.1. became known to the general public before it was lost or disclosed.
7.2.2. had been received from a third party before it was received by the Website Administration.
7.2.3. had been disclosed with the consent of the User.
- SETTLEMENT OF DISPUTES
8.1. Before filing a court action arising from the relationships between the Website User and Website Administration, submission of claim (written suggestion about a voluntary settlement) shall be essential.
8.2. The claimee shall notify the claimer about the results of examination of a claim within 30 (thirty) calendar days from the date of receiving the claim.
8.3. If the Parties are not able to come to a settlement, the dispute shall be referred for settlement to the judicial authority in accordance with current legislation of Ukraine.
8.4. Current legislation of Ukraine shall be applied in respect of this Confidentiality Policy and relationships between the User and Website Administration.
- SUPPLEMENTARY CONDITIONS
9.1. The Website Administration shall be entitled to make amendments to this Confidentiality Policy without the User’s consent.
9.2. A new Confidentiality Policy shall enter into force from the date of posting on the Website, unless otherwise stipulated by a revised version of the Confidentiality Policy.
